As you may have realized, you can get pardoned by a Board of Pardons at different levels. You can get pardoned at the state level, or the President of the United States at a federal level. In the next few weeks, I am going to focus on topics related to the presidential pardon. On this page, I want to focus on the role of the Pardon Attorney in granting and denying presidential pardons. Who Is The Pardon Attorney?

The Pardon Attorney is a person who helps the President of the United States in granting or denying executive clemency. He or she works for the Department of Justice. This is the department that has been responsible for assisting the President with pardon cases for over 100 years. All applications for pardons and clemency for federal offenses must go to this attorney. The Pardon Attorney and his or her office will then review each application and investigate each situation. This attorney will then make a recommendation on behalf of the Department of Justice. At this point, the application is sent to the President for the final decision.

The Pardon Attorney will receive each application for commutation of sentence, pardon, reprieve, and remission of fine/restitution. This attorney is also responsible for preparing all of the documents that the President has to sign when granting a pardon or another form of clemency. If you apply for a presidential pardon, whether denied or granted the pardon, you will get notified of the President’s decision by the Pardon Attorney. The Deputy Attorney General is also involved in the process of clemency recommendations to the President. Once this attorney prepares the Department of Justice’s recommendation, the Deputy Attorney General will sign the recommendation, uniting the Department in the decision.

Presidential pardons are granted for federal felony convictions. The President does not have the power to grant pardons for state offenses.
