What is Considered Public Indecency?

The crime of public indecency is governed by Connecticut General Statute § 53a-186. The statute gives three definitions of what it means to commit this crime. They are as follows:

(1)  A person engages in sexual intercourse while in a public place;

(2)  A person exposes themselves in a sexual way for sexual enjoyment while in a public place;

(3)  A person touches themselves or another person in a sexual way while in a public place;

Connecticut statute defines “public place” as any place where the person’s actions can be expected to be viewed by others.

What are the Penalties of Public Indecency?

Public indecency is considered a Class B misdemeanor in Connecticut. There are two types of crimes in Connecticut – misdemeanors and felonies. These types of crimes are then broken down into “classes,” as mentioned above. Class A is the most serious, while Class D is the least serious. In general, misdemeanors are less serious crimes than felonies, but they still carry unfortunate consequences that you want to avoid if at all possible. As mentioned above, public indecency is a Class B misdemeanor. The penalties for a Class B misdemeanor are a term of imprisonment of a maximum of six months and a fine of as much as $1,000. Conn. Gen. Stat. § 53a-36; Conn. Gen. Stat. § 53a-42. These are the maximum penalties that you face for a public indecency charge. If possible, you want to get the court to reduce these penalties.
