Hello and welcome back to Attorney Paz’s rants of a criminal defense attorney. This week I want to toot my own horn a little bit. I’ve been working on a sentence modification for a client of mine who is incarcerated, and I was able to achieve one! What is Sentence Modification?
Sentence modification means that you have filed a motion to the court requesting the court, after you’ve already been sentenced, to modify your sentence for a variety of reasons. Now the statute provides that you can only petition the court for such a modification if you’ve been sentenced for a sentence of over three years if the state attorney consents. It is not easy to get the state attorney to consent. And nine tenths of the battle in a sentence modification is convincing the state attorney that they should agree to this.
So I’ve been working for months on getting the state attorney to consent in this particular case. It’s a guy who hasn’t served any real time in a very long time but kind of fell off the wagon, was drinking, and so was involved in a series of larcenies, one of which turned into a robbery. Basically he just fell down the rabbit hole. In the end, he was sentenced to five years as a persistent larceny offender.
Five years is a long time. So what I did was I filed the sentence modification, I worked with the state attorney, and he consented, and I got back the granting of the motion from the court to modify his sentence from five years down to three and a half. Now while that doesn’t seem like a lot, a year and a half is a year and a half of a man’s life. Think about how long a year and a half is and what you were doing a year and a half ago, and how different your life was a year and a half ago. And now you understand why saving a year and a half of a man’s life is so important.
So just to toot my own horn a little bit, I got a sentence modification granted today, and I saved a year and a half of a man’s life.
